Terms of Service

1. Who these terms are with

Glixy is operated by Glixy LLC, a limited liability company formed under the laws of the State of Delaware, United States ("Glixy", "we", "us").

Every enquiry has an address, and each one is read by a person:

  • support@glixy.ai — your account, your credits, billing, and anything about these terms, including formal notices. We will provide the details of our registered agent for service of process on request.
  • privacy@glixy.ai — your personal data and your rights over it, including any request under the GDPR, the UK GDPR or a state privacy law.
  • abuse@glixy.ai — an image that depicts you, or any misuse of the service.

By creating an account or using the service you agree to these terms. If you do not agree to them, do not use Glixy.

2. What the service does

Glixy takes a photograph of a face that you provide and a photo or video that you provide, and produces a new file in which the face has been substituted. The work runs on rented GPU hardware and usually takes under a minute. Nothing is installed on your device.

The result is a synthetic image. It is not a photograph of anything that happened, and neither we nor you should present it as one.

3. Your account

You need an account, which requires a working e-mail address. You are responsible for what happens under your account and for keeping access to it secure. Tell us promptly if you believe someone else is using it.

You must be at least 18 years old to use Glixy, and old enough to enter a binding contract where you live if that age is higher. You may not create an account on behalf of someone else.

You can delete your account at any time from Settings in the app. Deletion removes your account, your run history and your credit records. It cannot be undone, and any unspent credits are lost.

4. What you may upload

You must have the right to use every face and every file you upload. In practice that means one of two things: it is your own face and your own footage, or the person whose face it is has agreed to this specific use and you can show that if asked.

A face is biometric information about a real person. Uploading someone else's face without their agreement is not a grey area — in many places it is unlawful on its own, before anything is done with the result.

5. What you may not do

You may not use Glixy to produce, or attempt to produce:

  • any sexual or nude depiction of a real person who has not agreed to it, and under no circumstances any sexual depiction of a minor — this is reported, not merely refused;
  • material that shows a real person appearing to say or do something they did not, where the point is to make someone believe it: fake evidence, fake endorsements, fake statements by public figures, fabricated news;
  • impersonation for fraud, including anything intended to defeat identity verification, "know your customer" checks or facial recognition;
  • harassment, bullying, intimidation, or material targeting a particular person for abuse;
  • anything else unlawful where you are, or where the subject is.

You also may not resell or redistribute access to the service, attempt to circumvent credit charging or rate limits, probe or attack the infrastructure, or use automated means to create accounts.

Where a result could reasonably be mistaken for real footage of a real person, you must label it as artificially generated when you share it. This is not only good manners. If you publish in the European Union, Article 50 of the EU AI Act obliges you, as the person deploying the result, to disclose that it was artificially generated or manipulated. Equivalent rules exist elsewhere and are spreading.

6. Your files and your results

You keep every right you already had in what you upload, and we claim no ownership of what comes out. We use your files for exactly one purpose: producing the result you asked for, and letting you download it before it is deleted.

We do not train anything on your uploads or your results. The models are fixed, third-party models shipped with the service; they do not learn from your runs. We do not publish, share or sell your files, and there is no gallery.

Everything you upload and everything we produce is deleted after 24 hours. You can delete any of it sooner from the app. This is a design property, not a promise about our diligence — the privacy policy explains the two mechanisms that enforce it.

7. Credits, payment and refunds

Glixy is prepaid. You buy credits and spend them per run; there is no subscription. Prices are on the pricing page, and the app shows you the exact cost of a run before it starts. Credits are held when a run starts and settled when it finishes: you are never charged more than the amount you approved, and a run that fails is refunded automatically.

Credits have no cash value, cannot be transferred between accounts, and cannot be converted back into money except as described in the refund policy, which forms part of these terms. Payment is settled in cryptocurrency through an external payment provider; that transfer is final and cannot be reversed by us.

We may change prices. A change never affects credits you have already bought — those keep the number of credits you were sold.

8. Availability

Glixy is provided as it is, with no uptime commitment. Runs depend on GPU capacity we rent from a third party, and capacity can be unavailable. If a run fails for any reason, its credits are returned; that is the whole of our liability for a failed run.

We may change, suspend or discontinue any part of the service. If we discontinue it entirely we will give at least 30 days' notice by e-mail where we can, stop selling credits immediately, and refund the unspent balance on any account that asks within 90 days of the closing date. Credits already spent on completed runs are not refunded, and credits forfeited under section 9 are not reinstated.

9. Suspension

We may suspend or close an account that breaks section 5, that we reasonably believe is being used unlawfully, or that is being used in a way that threatens the service or other users. Where the breach is serious we will do it without notice. Credits on a closed account are forfeited where the closure follows a breach of section 5.

10. Reporting an image of yourself

If you believe a Glixy result depicts you and you did not agree to it, write to abuse@glixy.ai. This is the fastest route and it is read by a person.

Tell us, as far as you can:

  • that the depiction is of you, and that you did not consent to it;
  • enough to identify the material — a link, a filename, a copy, or where you encountered it;
  • how to reach you, so we can confirm what we have done.

Where the material is an intimate depiction of you published without your consent, we will remove it, and any identical copy we can find, within 48 hours of a valid report, and we will close the account responsible. You do not have to prove anything beyond a good-faith statement that it is you and that you did not agree; you do not need a lawyer, and there is no fee.

In practice we usually hold nothing to remove: every upload and every result is deleted 24 hours after the run, so material more than a day old is already gone from our systems. That does not end the matter — the account behind it can still be closed, and we will act on credible reports whether or not the file still exists.

Reports about copyright or other rights go to the same address.

11. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost data, or the consequences of how you use a result. Our total liability to you, for all claims taken together, is limited to the greater of the amount you paid us in the twelve months before the claim arose, or US$100.

Nothing here limits liability that cannot lawfully be limited, and nothing here removes rights you have as a consumer under the law where you live.

12. Indemnity

You are responsible for the consequences of what you upload and what you do with a result. If a third party brings a claim against us because of it, you agree to cover the costs we reasonably incur.

13. Changes

We may update these terms. If a change materially affects you we will say so in the app or by e-mail before it takes effect. Continuing to use Glixy after that means you accept the updated terms.

14. Law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and disputes go to the state and federal courts sitting in New Castle County, Delaware, whose jurisdiction we both accept.

If you are a consumer, none of that deprives you of the protection of the mandatory law of the country you live in, or of your right to bring proceedings in your own local courts where that law gives you one. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
